Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pix-Vu ("Service", "we", "us", "our"), an AI-powered Facebook and Meta advertising management platform operated at pix-vu.com by Sentinel Holdings ("Company"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015 (UK) or the Consumer Rights Directive 2011/83/EU (EU). Where these Terms conflict with your statutory rights, your statutory rights shall prevail.

1. Service Description

Pix-Vu is a digital service (within the meaning of the Consumer Rights Act 2015) that provides AI-powered tools to help businesses create, manage, and optimise Facebook and Meta advertising campaigns. The Service includes:

  • AI-generated ad creatives (copy and images)
  • Automated campaign creation and launch
  • Audience testing and combination analysis
  • 24/7 budget optimisation and bid management
  • Competitor ad monitoring
  • Real-time performance dashboards

The Service is provided as a subscription-based software-as-a-service (SaaS) platform. It is a tool that assists with advertising management. We do not guarantee specific advertising results, return on ad spend, or revenue outcomes.

Under the Consumer Rights Act 2015, the Service will be provided with reasonable care and skill, will match any description we have given of it, and will be fit for purpose. If the Service does not meet these standards, you may be entitled to a remedy including a repeat performance or a price reduction.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You must be at least 18 years old. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access at support@pix-vu.com.

3. Subscription Terms

The Service is offered as a paid subscription with the following tiers:

  • Monthly: $99 per month (USD), billed monthly.
  • Quarterly: $59 per month (USD), billed as $177 every three months.
  • Annual: $49 per month (USD), billed as $588 annually.

Additional subscription terms:

  • Billing cycle: Your subscription renews automatically at the end of each billing period (monthly, quarterly, or annually) on the anniversary of your initial subscription date. You will be notified at least 7 days before each renewal.
  • Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at support@pix-vu.com. Upon cancellation, you will retain access to the Service until the end of your current billing period. No further charges will be applied.
  • Price changes:We reserve the right to modify subscription pricing with at least 30 days' written notice. Price changes will take effect at the start of your next billing cycle following the notice period. You may cancel before the new price takes effect.

4. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason, in accordance with the Consumer Rights Directive 2011/83/EU.

To exercise your right of withdrawal:

  • Send a clear statement of your decision to withdraw to support@pix-vu.com within 14 days of your initial purchase.
  • You may use the following model withdrawal statement (but it is not obligatory): "I hereby give notice that I withdraw from my contract for the provision of the Pix-Vu service, ordered on [date], name of consumer, address of consumer, date."
  • We will reimburse all payments received from you within 14 days of receiving your withdrawal notice, using the same payment method you used for the initial transaction.

If you have expressly consented to the provision of the Service beginning during the withdrawal period and acknowledged that you will lose your right of withdrawal once the Service has been fully performed, you may lose this right if the Service has been fully performed. For ongoing subscription services, you may still withdraw within 14 days and will receive a pro-rata refund for any unused portion of the service period.

5. 30-Day Money-Back Guarantee

In addition to your statutory rights, new subscribers are eligible for a full refund within 30 days of their initial subscription payment, no questions asked. To request a refund, contact us at support@pix-vu.com. Refunds are processed within 5–10 business days. This guarantee applies only to your first subscription payment. See our Refund Policy for full details. This guarantee is in addition to, and does not affect, your statutory rights.

6. Facebook Account Access & User Responsibilities

To use the Service, you must connect your Facebook (Meta) Ad Account via OAuth. By doing so, you grant Pix-Vu permission to:

  • Read access: View your ad account data, campaign metrics, audience information, and pixel data.
  • Ads management: Create, modify, pause, and manage advertising campaigns, ad sets, and ads on your behalf.

You acknowledge and agree that:

  • You own or are authorised to manage the Facebook Ad Account you connect.
  • You are solely responsible for your ad account, ad content, advertising budgets, and compliance with Meta's advertising policies.
  • You are responsible for setting and monitoring advertising budget limits.
  • Pix-Vu acts on your behalf based on your configuration and AI-driven optimisation, but final responsibility for ad spending remains with you.
  • You must comply with all applicable Meta advertising policies, community standards, and local advertising regulations.

7. Data Processing

In order to provide the Service, we process certain personal data as described in our Privacy Policy. By using the Service, you acknowledge that:

  • We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR), and the Data Protection Act 2018.
  • Our processing of your data is necessary for the performance of this contract (Article 6(1)(b) GDPR).
  • Where we act as a data processor on your behalf (for example, when processing your customers' advertising data), we will only process such data in accordance with your instructions and applicable data protection law.
  • We implement appropriate technical and organisational measures to protect personal data.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Promote prohibited products, services, or content through the Service.
  • Attempt to gain unauthorised access to the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Resell, sublicense, or redistribute access to the Service without our written consent.

9. Intellectual Property

The Service, including its software, design, and documentation, is owned by Sentinel Holdings and protected by intellectual property laws. You retain ownership of your ad account data and any original content you provide. Ad creatives generated by the Service using AI are provided for your use in connection with your advertising campaigns.

10. Limitation of Liability

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any matter in respect of which it would be unlawful to exclude or restrict liability.
  • Any liability that cannot be excluded or limited under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

Subject to the above:

  • The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that any specific advertising results will be achieved.
  • We are not responsible for any losses arising from advertising campaign performance, ad spend decisions, Meta platform changes, account suspensions, or any third-party actions.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, whether direct or indirect.
  • Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.

If you are a consumer, this limitation of liability does not affect your statutory rights under applicable consumer protection law, including the Consumer Rights Act 2015 (UK) and the Consumer Rights Directive (EU).

11. Indemnification

If you are using the Service for business purposes (and not as a consumer), you agree to indemnify, defend, and hold harmless Sentinel Holdings and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your advertising content, or your violation of these Terms. This clause does not apply to consumers.

12. Termination

We may suspend or terminate your access to the Service if we reasonably believe you have materially violated these Terms, after giving you reasonable notice and an opportunity to remedy the breach (where reasonably practicable). Upon termination:

  • Your right to use the Service ceases immediately.
  • We will cease managing your advertising campaigns.
  • You may request an export of your data within 30 days of termination.
  • We may delete your data after 30 days following termination, subject to any legal retention requirements.

You may terminate your subscription at any time as set out in Section 3 above. Termination by us does not affect any refund rights you may have under Section 4 or Section 5, or your statutory rights.

13. Modifications to Terms

We reserve the right to update these Terms. We will notify you of material changes at least 30 days in advance via email or through the Service. If you do not agree with the updated Terms, you may cancel your subscription before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

If you are a consumer in the UK, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

If you are a consumer in the EU, you will benefit from any mandatory provisions of the law of the EU member state in which you are resident. You may also bring proceedings in the courts of the EU member state in which you are domiciled.

Dispute resolution: We encourage you to contact us first at support@pix-vu.com to resolve any dispute informally. If we cannot resolve a dispute informally, any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales (or, for EU consumers, the courts of your member state of domicile).

EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
